In 2016, the Building (Earthquake-prone Buildings) Amendment Act 2016 was introduced to address the issue of seismic vulnerability amongst existing buildings in Aotearoa New Zealand. This Act introduced a mandatory scheme to remediate buildings deemed particularly vulnerable to seismic hazard, as recommended by the 2012 Royal Commission into the Canterbury earthquake sequence of 2010–2011. This Earthquake-prone Building (EPB) framework is unusual internationally for the mandatory obligations that it introduces. This article explores and critiques the operation of the scheme in practice through an examination of its implementation provisions and the experiences of more recent seismic events (confirmed by engineering research). This analysis leads to the conclusion that the operation of the current scheme and particularly the application of the concept of EPB vulnerability excludes large numbers of (primarily urban) buildings which pose a significant risk in the event of a significant (but expected) seismic event. As a result, the EPB scheme fails to achieve its goals and instead may create a false impression that it does so
More than 600 Christchurch home-owners face a wait of up to 18 months before its decided who foots the bill for earthquake repairs that could cost hundreds of millions of dollars. The problem - first revealed on Checkpoint in March - is that owners bought homes thinking all quake damage had been identified and fixed - only to find more problems that weren't addressed. The people affected cannot claim on their insurance - because the damage pre-dates them buying the house - and any grant from the Earthquake Commission is capped. EQC has publicly apologised to those affected but the Minster, Megan Woods, says it's unclear who will pay for the needed repairs.
As a result of the findings and recommendations of the Royal Commission of Inquiry into the Canterbury Earthquake Swarm of 2010-2011 the New Zealand Government has introduced new legislation that will require the mandatory strengthening of all earthquake-prone buildings in New Zealand. An earthquake prone building is currently defined as a building that is less than one third the seismic strength of a new building. If an owner does not wish to strengthen their buildings then they must demolish them. Seismic retrofitting of buildings is a form of property development and as such, the decision to retrofit or not should be based on a robust and soundly conducted feasibility study. Feasibility studies on seismic retrofitting can be particularly challenging for a number of reasons thus making it difficult for owners to make informed and sound decisions relating to their earthquake prone buildings. This paper considers the concept and process of feasibility analysis as applied to earthquake prone buildings and discusses the current challenges posed by such feasibility studies. A number of recommendations are made in an attempt to help develop a best practice model for decision making relating to earthquake prone buildings."
The bill to fix botched EQC repairs from the Canterbury earthquakes has hit $270 million - four times what the previous Government predicted just two years ago. The government plans to introduce legislation to change the Earthquake Commission's operations, after a report found major failings. It found EQC was woefully unprepared as it dealt with the Canterbury quakes, and made dozens of recommendations about clarifying EQC's role and improving the way it deals with claimants. A Christchurch homeowner in a five year battle with the Earthquake Commission over the damaged house she unwittingly bought says a critical new report about EQC tells her nothing new. The 27 page review by Independent Ministerial Advisor Christine Stevenson looks at how to resolve the 3,600 claims that still haven't been settled after the 2010 and 2011 quakes. The recommendations include getting the Commission to hire more staff and to stop forcing people to use the Official Information Act to get their files. It also suggests giving EQC more power to settle the on-sold claims where people bought houses under the impression all damage had been identified and fixed. Georgina Hannafin has a home that needs $260,000 worth of repairs but EQC has offered her just $48,000.
A scathing inquiry into the Earthquake Commission's handling of the 2010 and 2011 Canterbury earthquakes could mean huge change for how it handles claims. The Government says it's committed to implementing all of the recommendations from the inquiry, including improving its communication, planning and preparedness and dispute resolution. John Goddard, an insurance and employment law barrister who dealt with more than 4000 claims at the time, says repairs were handled poorly and the new recommendations won't cover all the bases. The families of the victims of the CTV building collapse in Christchurch have told an engineering disciplinary hearing they've been waiting 12 years for accountability. The building collapsed in the February 2011 earthquake killing 115 people. It was designed by Dr Alan Reay's firm - Reay was criticised by the Earthquake Royal Commission for handing sole responsibility of it to an inexperienced employee. Reay has tried to stop the disciplinary process going ahead but it got underway in Christchurch today. Reporter Anna Sargent spoke to Charlotte Cook.

The Canterbury earthquake sequence (2010-2011) was the most devastating catastrophe in New Zealand‘s modern history. Fortunately, in 2011 New Zealand had a high insurance penetration ratio, with more than 95% of residences being insured for these earthquakes. This dissertation sheds light on the functions of disaster insurance schemes and their role in economic recovery post-earthquakes. The first chapter describes the demand and supply for earthquake insurance and provides insights about different public-private partnership earthquake insurance schemes around the world. In the second chapter, we concentrate on three public earthquake insurance schemes in California, Japan, and New Zealand. The chapter examines what would have been the outcome had the system of insurance in Christchurch been different in the aftermath of the Canterbury earthquake sequence (CES). We focus on the California Earthquake Authority insurance program, and the Japanese Earthquake Reinsurance scheme. Overall, the aggregate cost of the earthquake to the New Zealand public insurer (the Earthquake Commission) was USD 6.2 billion. If a similar-sized disaster event had occurred in Japan and California, homeowners would have received only around USD 1.6 billion and USD 0.7 billion from the Japanese and Californian schemes, respectively. We further describe the spatial and distributive aspects of these scenarios and discuss some of the policy questions that emerge from this comparison. The third chapter measures the longer-term effect of the CES on the local economy, using night-time light intensity measured from space, and focus on the role of insurance payments for damaged residential property during the local recovery process. Uniquely for this event, more than 95% of residential housing units were covered by insurance and almost all incurred some damage. However, insurance payments were staggered over 5 years, enabling us to identify their local impact. We find that night-time luminosity can capture the process of recovery; and that insurance payments contributed significantly to the process of local economic recovery after the earthquake. Yet, delayed payments were less affective in assisting recovery and cash settlement of claims were more effective than insurance-managed repairs. After the Christchurch earthquakes, the government declared about 8000 houses as Red Zoned, prohibiting further developments in these properties, and offering the owners to buy them out. The government provided two options for owners: the first was full payment for both land and dwelling at the 2007 property evaluation, the second was payment for land, and the rest to be paid by the owner‘s insurance. Most people chose the second option. Using data from LINZ combined with data from Stats NZ, the fourth chapter empirically investigates what led people to choose this second option, and how peer effect influenced the homeowners‘ choices. Due to climate change, public disclosure of coastal hazard information through maps and property reports have been used more frequently by local government. This is expected to raise awareness about disaster risks in local community and help potential property owners to make informed locational decision. However, media outlets and business sector argue that public hazard disclosure will cause a negative effect on property value. Despite this opposition, some district councils in New Zealand have attempted to implement improved disclosure. Kapiti Coast district in the Wellington region serves as a case study for this research. In the fifth chapter, we utilize the residential property sale data and coastal hazard maps from the local district council. This study employs a difference-in-difference hedonic property price approach to examine the effect of hazard disclosure on coastal property values. We also apply spatial hedonic regression methods, controlling for coastal amenities, as our robustness check. Our findings suggest that hazard designation has a statistically and economically insignificant impact on property values. Overall, the risk perception about coastal hazards should be more emphasized in communities.

Many Christchurch trades people are refusing to carry out quake repairs unless the homeowner agrees to pay the bill, saying it takes too long to get the money out of the Earthquake Commission. Some contractors say they still haven't been paid for jobs done after the quake in September and the amount of debt some businesses are carrying are putting them in jeopardy.
There's growing frustration over the government's work to match it's promise to tackle the country's suicide rates. A Mental Health Commission report describes frustration over the pace of change - and points to an urgent need for an overarching action plan. Mental health advocates are also criticising the lack of progress in helping people in Canterbury, with many still severely affected by ongoing trauma from earthquakes and the 2019 Mosque shootings. A lawyer who is suing Southern Response on behalf of earthquake claimants says he was intimidated by private investigators for another government agency in 2013. Southern Response is in charge of settling the outstanding quake claims of former AMI customers in Christchurch, but is now under investigation by the public sector watchdog, the State Services Commission. The Commission is looking at whether standards of integrity and conduct for state servants have been breached in its hiring of security company, Thompson and Clark. Southern Response says it hired the firm in 2014 to assess the level of risk some customers posed to staff. Lawyer Grant Shand tells Guyon Espiner he's waiting to see the results of the inquiry.

Christchurch's historic Theatre Royal will reopen for business in November, with bookings about to open for the first show, the Royal New Zealand Ballet season of "A Christmas Carol" The 106-year old theatre has been closed for almost four years because of earthquake damage in the 2010 and 2011 earthquakes. The $40million rebuild and restoration project will be completed over the next five months and on 17 November 2014, the 'Grand Old Lady' of New Zealand theatre will reopen her doors for performances.
